Résumé
Bien qu’elle soit physiquement absente des audiences du tribunal liées à son asservissement et à sa vente à un nouveau propriétaire, Elena, une femme asservie pendant les dernières années du Santo Domingo colonial, devient le témoin permanent et donne la parole à sa vie à travers le témoignage des autres. Les données partagées par Sebastián Álvarez, l’acheteur ; Baltazar Guerrero, le vendeur, et les témoins donnent vie au personnage d’Elena à travers des descriptions de ses prétendus «défauts». Cet article étudie le procès d’Álvarez contre Guerrero pour avoir omis de spécifier correctement tous les défauts d’Elena dans le contrat de vente. Je soutiens que le comportement insouciant d’Elena - décrit dans l’affaire de révocation - lui a permis de revendiquer une «liberté» qu’elle a acquise en utilisant son corps comme un «rival géographique» pour défier les contraintes de l’espace. Par conséquent, cet article propose que, en même temps que les esclaves enduraient la souffrance, ils utilisaient leur corps et leur esprit comme une forme de refuge. En outre, cet article utilise l’histoire d’Elena pour mettre en lumière Santo Domingo dans l’historiographie de l’esclavage dans les Amériques, dans le contexte de «l’inattendu» dans les études caribéennes, et souligne l’importance de la recherche archivistique pour donner la parole aux personnes asservies, même si elles ne parlent pas pour eux-mêmes.
